Limited Loss Damage Waiver (LLDW) Agreement

This Limited Loss Damage Waiver (“LLDW”) is an optional agreement provided by Big Island Jeep Rental LLC to reduce the financial responsibility of the Renter in the event of damage to or loss of the rental vehicle, subject to the terms and conditions set forth below.

1. Acceptance of LLDW

  • If the Renter declines the LLDW, the Renter remains fully responsible for all damage to or loss of the rental vehicle, subject to the rental agreement terms.

2. Coverage

The LLDW limits the Renter's liability for damage to the rental vehicle to a maximum of $1000 per incident, subject to compliance with all terms of this agreement. What this covers:

Renter is still obligated to provide full coverage vehicle insurance

If an accident occurs, renter is not liable for payment of their insurance deductible, up to $1000.

If the damage to the vehicle is found to be less than $1000, renter is not obligated to pay, and no claim will be made to the renters’ insurance company

Other common incidents that are covered under this agreement, that are normally not without this LLDW-

Tire repairs (not from negligence), windshield repairs and replacement.

This waiver does not apply to:

  • Damages resulting from prohibited uses of the vehicle as described in Section 5.

  • Gross negligence, intentional misconduct, or violation of any applicable law while operating the vehicle.

3. Exclusions

The LLDW does not cover the following:

  • Theft of the vehicle resulting from the Renter's failure to exercise ordinary care (e.g., leaving keys in the vehicle).

  • Damage caused by unauthorized drivers or individuals not listed on the rental agreement.

  • Interior/exterior damage caused by negligence (i.e. driving into the ocean, ripping soft top windows, etc)

  • Loss or damage to personal property inside the vehicle.

4. Conditions of Coverage

To qualify for LLDW coverage, the Renter must:

  1. Immediately report any accidents or damage to the Rental Agency.

  2. Obtain a police report in the event of an accident, theft, or vandalism.

  3. Cooperate with the Rental Agency and its insurance representatives in any investigation.

5. Prohibited Uses

The LLDW becomes null and void if the Renter uses the vehicle in any of the following prohibited ways:

  • Engaging in illegal activities.

  • Driving under the influence of drugs or alcohol.

  • Participating in racing or off-road use (not on a “maintained trail”).

  • Sub-renting or allowing unauthorized drivers to operate the vehicle.

6. Limitations of Liability

  • The Rental Agency’s liability is limited to the terms of the LLDW and does not extend to any injuries, loss of personal property, or third-party liabilities.

  • Acceptance of the LLDW does not absolve the Renter from liability for damage exceeding the coverage limit.

7. Termination of LLDW

The LLDW may be terminated by the Rental Agency at any time if the Renter violates the rental agreement or the terms of this waiver.

8. Governing Law

This agreement shall be governed by the laws of the state/province of Hawaii/Hawaii County, and any disputes shall be resolved in the courts of Hawaii County.
